SWEEPSTAKES PERIOD: This Sweepstakes begins on 7/15/2022 and ends on 8/15/2022 (the “Sweepstakes Period”).
ELIGIBILITY: The Sweepstakes is open to legal U.S. residents currently residing in the 50 United States including the District of Columbia who are the age of majority or older as of the date of entry and who are registered members of the Real Estate Board of New York (“REBNY”) as of the start of the Sweepstakes Period. Employees, officers, and directors of Sponsor or Sponsor’s parent, affiliates, subsidiaries, representatives, legal counsel, advertising, public relations, promotional, fulfillment, and marketing agencies, and members of their immediate families (spouses, parents, siblings and children, regardless of where they live) and those living in the same household are not eligible to enter or win. Employees, officers and directors of competitors of Sponsor or Sponsor’s affiliates are not eligible to enter or win. Participation constitutes entrant’s full and unconditional agreement to these Official Rules, which are final and binding in all matters related to the Sweepstakes. Sponsor reserves the right to verify the eligibility of winners.
HOW TO ENTER: To enter, REBNY members must take the following actions: (1) register for the Citysnap Pro application (using such REBNY member’s registered email address), which is included at no additional cost with REBNY membership (2) download the Citysnap application (which is free for everyone) on an Android or iOS mobile device and (3) log at least one “Pro” session on Citysnap Pro (a “Pro” session is defined by logging into the Citysnap app through your user profile connected to your REBNY membership) via such mobile device application during the Sweepstakes Period. If the REBNY member completes all three (3) steps, the member will be automatically be entered with one (1) entry into the Sweepstakes. In order for an entry to be valid, the entry must be completed in full, and all information provided must be truthful. Limit one (1) entry per person. CoStar is not responsible for lost, misdirected, false, corrupted, illegible or late entries. CoStar shall have the sole discretion to determine the validity of an entry. All potential winners are subject to verification before any prize will be awarded. Automated or bulk entries or entries submitted by third parties will be disqualified. Incomplete, illegible, corrupted or untimely entries are void and will be disqualified.
PRIZES: Five (5) prizes will be awarded. Five (5) eligible entrants will be randomly selected to each win a $5,000 cash prize. Total ARV of all prizes: $25,000. The odds of winning depend on the number of eligible entries received.
All prizes will be awarded. Prizes are non-transferable and no substitutions are allowed except by Sponsor who may award a prize for one of comparable or greater value for any reason. Winners are solely responsible for all applicable income or local taxes, insurance, and other applicable fees, and will be issued a 1099 form from the Internal Revenue Service for any prize greater than $600. The drawing is due on September 14, 2022, at the Citysnap launch event in New York City. If a potential winner fails to respond or is disqualified for any reason, Sponsor will award the prize to an alternate winner selected by random draw from all remaining entries. Winner agree to furnish any documentation requested by Sponsor in connection with the awarding of the Prize, including but not limited to, releases, and affidavit of eligibility. By accepting the prize, each winner agrees to make a public appearance, at Sponsor’s request and expense, and further grants permission to Sponsor to use winner’s name (both individual name and employer/company name), voice, likeness, and statements for publicity purposes without further compensation, consideration or consent, except where prohibited by law. By entering this Sweepstakes, each participant accepts and agrees to be bound by these Official Rules and the decisions of the Sponsor. By participating in this Sweepstakes, each participant also represents that there is no legal or contractual restriction barring participation, including, without limitation, any restriction from participant’s employer or company.
GENERAL CONDITIONS. This Sweepstakes is governed by the laws of the United States. IF, FOR ANY REASON, THE SWEEPSTAKES IS NOT CAPABLE OF RUNNING AS PLANNED, COSTAR RESERVES THE RIGHT AT ITS SOLE DISCRETION TO CANCEL, TERMINATE, MODIFY OR SUSPEND THE SWEEPSTAKES AT ANY TIME WITHOUT NOTICE OR OBLIGATION. COSTAR SHALL NOT BE RESPONSIBLE FOR ANY INCORRECT OR INACCURATE INFORMATION, INCLUDING, WITHOUT LIMITATION, ANY TECHNICAL OR HUMAN ERROR WHICH MAY OCCUR IN THE PROCESSING OF SUBMISSIONS IN THE SWEEPSTAKES. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be attempting to tamper with or undermine the entry process or the legitimate operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person. By participating in the Sweepstakes, all participants agree that the state and federal courts located in the District of Columbia shall have exclusive jurisdiction over claims arising out of the Sweepstakes and matters related thereto, and that all participants agree to the venue and jurisdiction of such District of Columbia courts.
In the event of a dispute over the identity of an entrant, online entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry and/or used for the entry actions. The “authorized account holder” is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address or social media account. A potential winner may be asked to provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address or account associated with a winning entry.
RELEASE AND LIMITATIONS OF LIABILITY: By participating in the Sweepstakes, participants agree to release and hold harmless Sponsor, and all officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) errors on Sponsor’s website; (c) lost, delayed, postage-due, misdirected, or undeliverable communications; or (d) errors in the administration of the Sweepstakes or the processing of entries. Participants agree that Sponsor, its parents, affiliates, subsidiaries, retailers, distributors, advertising and promotion agencies, suppliers, and those acting pursuant to its authority: (1) except where prohibited by law, shall have the right and permission to print, publish, broadcast, and use worldwide in any media now known or hereafter developed, including but not limited to the world wide web, at any time or times, the winner’s name (both individual name and employer/company name), portrait, picture, voice, likeness and biographical information for advertising, trade, and promotional purposes (including the announcement of his or her name on television or radio broadcast) without further consideration, compensation, permission, or notification, and (2) that the aforementioned parties and all of their respective officers, directors, employees, representatives and agents and their advertising and promotional agencies, and legal counsel shall have no liability whatsoever for, and will be held harmless by participants, against any liability for any injuries, losses, or damages of any kind to participants or any other person or entity, including personal injury or death to winner or any other person or damage to personal or real property, due in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the prize, entry, or participation in this promotion or in any promotion-related activity, or any claims based on publicity rights, defamation, or invasion of privacy or merchandise delivery. Participant further agrees that, in any cause of action, Sponsors’ liability will be limited to the cost of entering and participating in the Sweepstakes, if any, and in no event shall the Sponsor be liable for attorney’s fees. Without limiting the foregoing, everything regarding this Sweepstakes, including the web site and any prize, is provided “as is” without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions may not allow the limitation or exclusion of liability for incidental or consequential damages or exclusion of implied warranties, so some of the above limitations or exclusions may not apply. PRIVACY: Information collected from participants is subject to the Sponsor’s Privacy Policy, which can be found at http://www.costar.com/about/privacy-policy. Sponsor and Sponsor’s agents, affiliates, subsidiaries, representatives or service providers may use participants’ and/or referrals’ personal information submitted with entry for purposes of prize fulfillment and/or for future marketing by Sponsor, such as to notify them of a product or promotion that Sponsor thinks may be of interest.
